North Carolina Ignition Interlock Requirements (2026): Who Needs One & What It Costs
North Carolina does not require an ignition interlock for every DWI — a standard first offense under 0.15% BAC typically does not trigger it. The IID becomes required when your BAC was 0.15% or higher, when you were sentenced at Aggravated Level One, or for repeat offenders. Since June 2022, low-income drivers can qualify for free installation and 50% off monthly fees through a statutory hardship waiver. Here’s what triggers the requirement and what to expect.
| Offense term | DWI (Driving While Impaired) — NCGS 20-138.1 |
| All-offender? | No — IID is required for restoration when: BAC was 0.15%+ at time of offense; sentenced at Aggravated Level One (GS 20-179(f3)); or second/subsequent DWI within 7 years (GS 20-17.8(a)) |
| Standard 1st offense (BAC 0.08–0.14%) | No IID required for license restoration unless sentenced Aggravated Level One. Judge may order IID as condition of a limited driving privilege. |
| BAC 0.15%+ (1st offense) | IID required for restoration: 1 year from restoration date; revocation period is 1 year first (GS 20-17.8(c)) |
| 2nd DWI within 7 years | IID required: 3 years from restoration; revocation is 4 years (GS 20-17.8(c)) |
| 3rd+ DWI / permanent revocation | IID required: 7 years from restoration; underlying revocation is permanent (GS 20-17.8(c)) |
| Aggravated Level One sentencing | IID required regardless of BAC — triggered by presence of grossly aggravating factors at sentencing (GS 20-179(f3)) |
| Limited driving privilege | Judges may require IID as a condition of a limited driving privilege (LDP) during the revocation period (GS 20-179.3); time on LDP with IID counts toward the restoration IID term |
| Hardship waiver | Free installation + removal; 50% off monthly rate (GS 20-179.5(c), effective June 1, 2022). Income at/below 150% FPL or enrolled in TANF, SSI, SNAP, LIHEAP, or Medicaid. Affidavit + proof submitted to vendor; denial appealable to DMV. |
| Violation — final 90 days | Any violation in the 90 days before the IID term ends extends the requirement by 90 more days (or until violation-free) |
| Driving non-IID vehicle / BAC over 0.02 | Treated as driving-while-revoked; 1-year additional revocation |
| DMV fees | DWI restoration fee $167.75 + $50 service fee (effective July 1, 2024) |
| SR-22 required? | No — NC uses a DL-123 insurance certification form, not SR-22 or FR-44 |
| Who approves providers | NCDMV — ncdot.gov — Ignition Interlock Devices |
| Governing law | NCGS 20-17.8; 20-179.3; 20-179.5; 20-179 |
Does your DWI require an interlock in North Carolina?
The IID requirement in North Carolina is tied to specific offense characteristics — not every DWI triggers it:
- Standard 1st DWI, BAC 0.08–0.14%: No IID required for full license restoration, unless sentenced at Aggravated Level One. The judge may still require one as a condition of a limited driving privilege.
- BAC 0.15%+ at the time of the offense: IID is required as a condition of restoration — 1 year after your 1-year revocation ends.
- Aggravated Level One sentencing (GS 20-179(f3)): IID required regardless of BAC — triggered by multiple grossly aggravating factors (such as a prior DWI within 7 years, seriously injuring another person, or driving with a child passenger).
- Second or subsequent DWI within 7 years: IID required — 3 years from restoration (after 4-year revocation) for a second offense; 7 years (after permanent revocation) for a third or subsequent.
Hardship waiver: free installation & 50% off monthly
North Carolina’s statutory hardship waiver (GS 20-179.5(c), effective June 1, 2022) is one of the strongest cost-relief programs in the country. If you qualify:
- Free installation
- Free removal
- 50% off the monthly monitoring/lease rate
Who qualifies: income at or below 150% of the federal poverty line, OR current enrollment in TANF, SSI, SNAP, LIHEAP, or Medicaid.
How to apply: complete a hardship affidavit and submit proof of income or program enrollment directly to the vendor. The vendor must accept it or deny it in writing — a denial is appealable to NCDMV. Use the NCDMV Interlock Hardship form.

How to get installed — 5 steps
- Confirm with your attorney whether an IID is required in your case — check your BAC (0.15%+ triggers it), your sentencing level, and whether you have prior DWIs within 7 years. If your judge orders IID as an LDP condition, that time counts toward your restoration term.
- If you may qualify for the hardship waiver (income ≤150% FPL or SNAP/SSI/TANF/LIHEAP/Medicaid enrollment), gather documentation and prepare the NCDMV Interlock Hardship affidavit before contacting a provider.
- Contact an NCDMV-approved provider, confirm current approval, and submit your hardship affidavit if applicable. Schedule installation.
- Serve the full IID term. Keep a clean record — any violation in the final 90 days extends your term by 90 more days. Do not drive any vehicle without the required IID.
- After the IID term: NCDMV administers removal. Pay the $167.75 + $50 restoration fee to reinstate your license.
