Pennsylvania DUI Ignition Interlock Requirements (2026): IILL, Costs & Approved Providers
Pennsylvania’s IID system centers on the Ignition Interlock Limited License (IILL) — a restricted license that lets you drive with the device during your suspension period. A standard first-offense general-impairment DUI (BAC 0.08–0.099%) carries no suspension and no IID. High BAC, drugs, refusals, and repeat offenses trigger it. The 2-month Declaration of Compliance window is your exit gate. Here’s how it all works.
| Offense term | DUI (Driving Under the Influence) — 75 Pa.C.S. 3802 |
| All-offender? | No — first-offense general impairment (BAC 0.08–0.099%) carries no suspension and no IID requirement under current PA law |
| General impairment 1st offense (0.08–0.099%) | No license suspension; no IID required. ARD (Accelerated Rehabilitative Disposition) may apply. |
| High BAC 1st offense (0.10–0.159%) | 12-month suspension; IILL available immediately; roughly 1-year interlock period under 3805 |
| Highest BAC 1st offense (0.16%+) or refusal or drugs | 12-month suspension; IILL available immediately; 1-year interlock period under 3805 |
| Minor passenger 1st offense | Raises grading under 3803; suspension and IILL/IID apply. No standalone IID trigger — the grading elevation brings it in. |
| 2nd offense | 12–18 month suspension by tier; IILL available after ~6 months; 1-year interlock period under 3805 before unrestricted restoration |
| 3rd+ offense | 12–18 months by tier (5-year revocation scenarios exist); IILL after ~6 months; 1-year interlock under 3805 before unrestricted license |
| IILL — what it is | Ignition Interlock Limited License — permits driving any vehicle equipped with a PennDOT-approved IID during the suspension/interlock period (75 Pa.C.S. 1556) |
| IILL petition fee | $85 non-refundable (form DL-9108). Separate PennDOT restoration fee stated in your restoration letter. |
| Hardship exemption | Income below 200% of federal poverty guidelines, or participation in a listed assistance program → IID on one vehicle only; no fee subsidy. Vendor certifies to PennDOT. |
| Declaration of Compliance | Vendor files that no failed/missed tests or 0.08%+ readings occurred in the prior 2 months → PennDOT issues unrestricted license (3805(h.2)) |
| Driving without IID (3808) | 1st conviction: interlock extended 12 months from conviction. 2nd conviction: IILL recalled + 12-month additional suspension. |

Does your Pennsylvania DUI require an interlock?
Pennsylvania’s DUI statute (75 Pa.C.S. 3802) has three BAC tiers, and the IID/IILL requirement depends on which tier your offense falls in:
- General impairment (BAC 0.08–0.099%), first offense: No license suspension and no IID required for a first offense in this tier. ARD (Accelerated Rehabilitative Disposition) is typically available as an alternative.
- High BAC (0.10–0.159%), first offense: 12-month suspension; IILL available immediately; approximately 1-year interlock period.
- Highest BAC (0.16%+), refusal, or controlled substance, first offense: 12-month suspension; IILL available immediately; approximately 1-year interlock period.
- Any DUI, second or subsequent offense: Suspension and IILL/IID required in all tiers for repeat offenders (12–18 months by tier; IILL after approximately 6 months of suspension).
How the IILL works
The Ignition Interlock Limited License (IILL) under 75 Pa.C.S. 1556 is Pennsylvania’s mechanism for driving during a DUI-related suspension. It permits you to operate any vehicle that is equipped with a PennDOT-approved IID. To get an IILL:
- Wait the required period into your suspension (immediately for high/highest BAC first offenses; approximately 6 months for second and subsequent)
- File form DL-9108 (IILL petition) with PennDOT and pay the $85 non-refundable fee
- Install a PennDOT-approved IID in any vehicle you will operate
- PennDOT issues the IILL — you may drive those vehicles for the interlock period
The IILL interlock period runs under 75 Pa.C.S. 3805. Toward the end, you need a 2-month clean window to qualify for unrestricted restoration.
Hardship exemption — one vehicle, no fee discount
Pennsylvania’s Financial/Economic Hardship Exemption (75 Pa.C.S. 3805; 67 Pa. Code 88.102) reduces the administrative burden for qualifying low-income drivers — but note what it does and does not provide:
- What it provides: You are required to install the IID on only ONE vehicle (instead of all vehicles you own or operate), which reduces total device costs if you have multiple vehicles.
- What it does NOT provide: No fee subsidy — you still pay full device installation and monthly costs. There is no state fund that covers or reduces IID costs under this exemption.
- Eligibility: Adjusted gross household income below 200% of the federal poverty guidelines, or participation in a listed state assistance program. Your provider certifies your eligibility to PennDOT.

How to get your IILL and install — 5 steps
- Confirm with your attorney which BAC tier your offense falls in — this determines whether an IID/IILL is required at all and when you become eligible to apply.
- When eligible, complete form DL-9108 (IILL petition) and submit to PennDOT with the $85 non-refundable fee. If applying for the hardship exemption (200% FPL or assistance program), inform your provider — they certify your eligibility to PennDOT.
- Contact a PennDOT-approved provider, confirm current approval, and schedule installation. Install in every vehicle you operate (or just one if hardship exemption applies).
- Drive with clean compliance. In the 2 months before your interlock period ends, maintain a perfect record — no failed tests, missed tests, or 0.08%+ readings. PennDOT notices you ~30 days before eligibility.
- Provider files the Declaration of Compliance → PennDOT issues your unrestricted license. Do not remove the device until PennDOT authorizes.
