Rhode Island DUI Ignition Interlock Requirements (2026): Who Needs One & What It Costs

Rhode Island does not mandate an ignition interlock for every DUI — a first offense below 0.15% BAC is at the judge’s discretion. However, IID becomes mandatory at BAC 0.15%+, for all second and third offenses, and for anyone who needs a conditional hardship license during their suspension. Here’s who needs one and what to expect.

Does your Rhode Island DUI require an interlock?

Rhode Island’s IID requirement depends on your BAC, offense number, and whether you need a hardship license:

  • First offense, BAC 0.08–0.14%: The judge may order an IID — it is not guaranteed. Whether a judge orders it depends on your court, county, and case circumstances. Confirm with your attorney what to expect in your specific jurisdiction.
  • First offense, BAC 0.15%+: The judge shall order an IID — it is mandatory under 31-27-2(d)(1)(iii).
  • Second or third offense: Mandatory IID regardless of BAC; 6 months to 2 years (2nd), 1 to 4 years (3rd).
  • Seeking a conditional hardship license: IID required as a condition, regardless of offense level or BAC. If you need to drive during your suspension, you will need the device.
Need a hardship license? An IID is required. Rhode Island’s conditional hardship license — which allows driving during a DUI suspension for employment or other essential needs — requires an IID as a condition of issuance. This applies regardless of your BAC or whether the court independently ordered an IID. If driving during your suspension is important to you, plan for an IID from the start.

How to get installed — 5 steps

  1. Confirm with your attorney whether the IID was ordered by the court. If not ordered and your BAC was under 0.15%, you may not be required to install — but you will need one if you apply for a conditional hardship license.
  2. If IID is required: contact an RI DMV-approved provider, confirm current approval, and schedule installation. Pay the $100 RI DMV interlock monitoring fee and $27.50 license restriction update fee.
  3. Bring your vehicle and court order to the installation appointment. The provider will notify RI DMV of the installation.
  4. Serve the full court-ordered IID period. Resolve any lockout within 48 hours — an unresolved lockout requires service. Violating a court IID order is a misdemeanor.
  5. After the court-ordered period ends, apply to RI DMV for removal authorization. DMV must authorize before the provider de-installs. Pay the $352.50 reinstatement fee at full restoration.

Rhode Island DUI interlock FAQ

Is an interlock mandatory for a first DUI in Rhode Island?
It depends on your BAC. At BAC 0.15%+ the judge shall order an IID — it is mandatory under 31-27-2(d)(1)(iii). At BAC 0.08–0.14%, the judge may order it — it is discretionary. Even if the court does not order an IID, you will need one if you apply for a conditional hardship license to drive during your suspension.
Do I need an IID for a Rhode Island hardship license?
Yes — Rhode Island’s conditional hardship license requires an IID as a condition of issuance, regardless of your BAC or whether the court independently ordered one. If you need to drive to work or for other essential purposes during your DUI suspension, plan for the IID from the start.
How long is the IID requirement in Rhode Island?
The range is set by statute (31-27-2.8): 3 months to 1 year for a first offense, 6 months to 2 years for a second offense, and 1 to 4 years for a third offense. The specific term within those ranges is set by the court at sentencing. At the end of the court-ordered period, apply to RI DMV for removal authorization before having the device removed.
Is there financial assistance for IID costs in Rhode Island?
No state IID cost-assistance program was found in Rhode Island statute or DMV materials. RI DMV imposes a $100 interlock monitoring fee and a $27.50 license restriction update fee on top of device costs. All costs are paid out of pocket.
Does Rhode Island require SR-22 insurance after a DUI?
No — RI DMV explicitly states that “Financial Responsibility (SR-22) is no longer required by the State of Rhode Island.” You are not required to obtain an SR-22 filing after a DUI. Your auto insurance premium will still increase at renewal after a conviction.
